The Third-Party Clause

Paloma had been using the school's approved study app since ninth grade, tracking her focus sessions and quiz scores. She had never read past the first line of its privacy policy. Nobody her age actually read those, or so she'd always assumed.

पलोमा नौवीं कक्षा से स्कूल के मंज़ूर किए हुए स्टडी ऐप का इस्तेमाल कर रही थी, जिसमें वह अपने फ़ोकस सेशन और क्विज़ के अंक दर्ज करती थी। उसने उसकी प्राइवेसी पॉलिसी की पहली पंक्ति से आगे कभी कुछ नहीं पढ़ा था। उसकी उम्र का कोई भी इन्हें सच में नहीं पढ़ता, या कम से कम वह हमेशा यही मानती आई थी।

Everything changed the day her older brother, studying data privacy at university, asked to see the app on her phone.

सब कुछ उस दिन बदल गया जब उसके बड़े भाई ने, जो यूनिवर्सिटी में डेटा प्राइवेसी पढ़ रहा था, उसके फ़ोन पर वह ऐप देखने को माँगा।

"Did you know this thing sells your usage patterns to a marketing firm?" he asked, scrolling through settings she'd never opened. "Your study habits, your stress levels during exams — all of it, packaged and sold."

"क्या तुम्हें पता है कि यह ऐप तुम्हारे इस्तेमाल के पैटर्न एक मार्केटिंग कंपनी को बेचता है?" उसने उन सेटिंग्स को खँगालते हुए पूछा जो पलोमा ने कभी खोली ही नहीं थीं। "तुम्हारी पढ़ाई की आदतें, परीक्षा के दौरान तुम्हारा तनाव, सब कुछ, पैक करके बेचा जाता है।"

"It's a school app, though," Paloma said. "The school wouldn't approve something that does that."

"लेकिन यह तो स्कूल का ऐप है," पलोमा ने कहा। "स्कूल ऐसी चीज़ को मंज़ूरी नहीं देगा जो ऐसा करती हो।"

"The school probably didn't read the fine print either," her brother said. "Third-party data sharing is buried in clause fourteen. I only found it because I was looking."

"शायद स्कूल ने भी बारीक अक्षर नहीं पढ़े होंगे," भाई ने कहा। "तीसरे पक्ष के साथ डेटा साझा करने की बात धारा चौदह में दबी हुई है। मुझे यह सिर्फ़ इसलिए मिली क्योंकि मैं ढूँढ रहा था।"

Paloma felt a strange mix of embarrassment and anger — embarrassed that she hadn't checked, angry that checking had been made so difficult. If the terms had been written clearly, she would have noticed months ago.

पलोमा को शर्मिंदगी और ग़ुस्से का अजीब मिला-जुला एहसास हुआ। शर्मिंदगी इसलिए कि उसने जाँच नहीं की थी, और ग़ुस्सा इसलिए कि जाँच करना इतना मुश्किल बना दिया गया था। अगर शर्तें साफ़ भाषा में लिखी होतीं, तो उसे महीनों पहले पता चल जाता।

She brought it up with her school counselor the next day, expecting to be told it wasn't a big deal.

अगले दिन उसने यह बात स्कूल की काउंसलर से कही, इस उम्मीद में कि उससे कहा जाएगा कि यह कोई बड़ी बात नहीं है।

"I'll be honest, I never read past the summary either," the counselor admitted. "Let me look into it properly before I recommend it to anyone else."

"सच कहूँ तो मैंने भी कभी सारांश से आगे नहीं पढ़ा," काउंसलर ने मान लिया। "किसी और को इसकी सलाह देने से पहले मुझे इसे ठीक से देख लेने दो।"

Two weeks later, the school sent a notice to all students. The app's contract was under review, and a version with stricter data settings was being considered as a replacement.

दो हफ़्ते बाद स्कूल ने सभी छात्रों को एक नोटिस भेजा। ऐप के अनुबंध की समीक्षा चल रही थी, और उसकी जगह सख़्त डेटा सेटिंग्स वाले संस्करण पर विचार किया जा रहा था।

"You actually got something changed," her brother said, sounding genuinely surprised. "Most people just complain and move on."

"तुमने सच में कुछ बदलवा दिया," भाई ने सचमुच हैरान होकर कहा। "ज़्यादातर लोग बस शिकायत करके आगे बढ़ जाते हैं।"

"I didn't get anything changed yet," Paloma said. "I just asked one question the school hadn't asked."

"अभी कुछ बदला नहीं है," पलोमा ने कहा। "मैंने बस एक ऐसा सवाल पूछा जो स्कूल ने नहीं पूछा था।"

She still used the app while the review continued, but she read every settings menu now, disabling whatever she could. It felt less like using a tool and more like negotiating with one.

समीक्षा चलने के दौरान वह ऐप इस्तेमाल करती रही, पर अब वह हर सेटिंग मेन्यू पढ़ती थी और जो कुछ बंद कर सकती थी, बंद कर देती थी। अब यह किसी औज़ार को इस्तेमाल करने से ज़्यादा उससे मोल-भाव करने जैसा लगता था।

"Small thing," she told her brother. "But at least now I know what I agreed to."

"छोटी-सी बात है," उसने भाई से कहा। "पर कम से कम अब मुझे पता है कि मैंने किस बात पर हामी भरी थी।"
